1. Definitions

• Company means Trendz Outdoors Limited, its successors and assigns.

• Customer means the purchaser of Goods and includes any person acting on behalf of or with authority from the purchaser.

• Goods means all fireplaces, concrete structures, accessories, services, drawings, specifications and related items supplied by the Company.

• Services means delivery, installation coordination or related services supplied by the Company.

• Order means any order placed with the Company for Goods or Services.

2. Orders, Deposits & Payment

• Quotations are valid for 30 days unless otherwise stated.

• A 30% non-refundable deposit is required for all custom or made-to-order Goods.

• If production has commenced, the Customer is liable for all costs incurred if the Order is cancelled.

• Trendz may revise pricing and delivery timeframes if specifications or requirements change during manufacture.

• Payment terms are 20th of the month following invoice date for approved trade accounts unless otherwise agreed.

• Balances are required prior to dispatch.

• Overdue accounts incur interest at 18% per annum plus recovery and legal costs.

• Goods remain the property of Trendz until paid in full.

3. Delivery, Freight & Site Access

• Delivery dates are estimates only and delays outside Trendz’s control do not entitle cancellation or compensation.

• Risk in Goods passes upon delivery to the agreed address or transport depot.

• Transport insurance applies only until delivery to the nominated depot unless otherwise agreed.

• Customers must inspect Goods immediately upon arrival and before signing freight receipts.

• If immediate inspection is not possible, Goods must be signed for as 'damaged' with the freight company and Trendz notified immediately.

• The Customer must ensure safe and suitable truck, crane or Hiab access.

• The Customer is responsible for site readiness, permits, foundations and installation areas.

• Additional charges may apply for waiting time, failed deliveries, re-delivery, crane stand-downs or storage.

• If Goods are not collected or delivery accepted within 14 days of completion notification, storage fees may apply.

• Trendz is not liable for damage to driveways, paving, landscaping or accessways during delivery.

• Free freight promotions apply to fireplaces only unless otherwise stated.

4. Installation & Compliance

• Unless agreed otherwise in writing, Trendz supplies Goods only.

• Any installers recommended or coordinated by Trendz are independent contractors.

• Trendz is not liable for installation workmanship, Building Act compliance, council approvals or third-party contractor work.

• All fireplaces must be installed in accordance with Trendz specifications and AS/NZS 2918 standards.

• The Customer is responsible for obtaining all required permits, consents and approvals.

• Lighting and operating fireplaces is at the Customer’s own risk.

• The Customer is responsible for ensuring the selected fireplace model is suitable for their intended application and site requirements.

• Marketing photographs and promotional material are indicative only and may not represent final installed appearances.

5. Intellectual Property & Design Advice

• All drawings, renders, moulds, tooling, specifications, CAD files and related intellectual property remain the property of Trendz.

• Customers may only use Trendz drawings and specifications for installation of purchased Trendz products.

• Customers must not copy, reproduce, reverse-engineer or distribute Trendz products, designs or drawings.

• Trendz design guidance or technical advice is general only unless formally confirmed in writing.

• The Customer acknowledges they have not relied on verbal representations not confirmed in writing.

6. Product Characteristics & Variations

• Handmade concrete and plaster finishes may vary in colour, texture and appearance.

• Natural movement, crazing and hairline cracking may occur and are not considered defects.

• Dimensions and finishes may vary slightly due to the handmade nature of products.

• Fireplaces must be seasoned and operated in accordance with Trendz care instructions.

• Minor transport chips, surface imperfections and touch-up requirements may occur and do not constitute defects.

• Mild steel products installed in coastal environments may experience accelerated corrosion unless stainless steel upgrades are selected.

7. Maintenance & Care

• Customers must follow Trendz care and maintenance instructions.

• Failure to follow care instructions may void warranties.

8. Warranty

• Goods are warranted against manufacturing defects for 2 years from delivery.

• Warranty exclusions include normal wear, weathering, natural cracking, surface rust and hairline cracking.

• Damage from improper installation, misuse, overheating, environmental exposure or failure to follow care instructions is excluded.

• Unauthorised alterations or repairs void warranty claims.

• Warranty liability is limited to repair, replacement or refund at Trendz’s discretion.

• A formal warranty document is available on request.

9. Claims, Returns & Cancellations

• Claims for damage, shortages or defects must be notified to Trendz within 24 hours of delivery.

• Supporting photographs and repair quotes/invoices must be provided within 7 days.

• No repairs may be undertaken without Trendz’s prior written approval.

• Custom-made or manufactured Goods cannot be cancelled or returned once manufacture has commenced.

• Returns are not accepted unless approved and Goods must be unused and in original condition.

10. Limitation of Liability

• Trendz’s liability is limited to the price paid for the relevant Goods or Services giving rise to the claim.

• Trendz is not liable for indirect or consequential loss, delays, installation costs, accommodation costs or third-party claims.

• The Customer is responsible for insuring Goods once risk has passed upon delivery.

11. General

• Trendz may use project or installation photographs for marketing purposes unless agreed otherwise.

• Trade customers contract out of the Consumer Guarantees Act and relevant sections of the Fair Trading Act to the maximum extent permitted by law.

• Trendz may suspend supply, cancel orders or repossess unpaid Goods if payment obligations are breached.

• These Terms may be accepted by signed quotation, deposit payment, written approval, email confirmation or website order.

• These Terms are governed by New Zealand law.
